The controller is not required to designate a data protection officer and has therefore not designated one.
2. When do we process personal data?
serverguru.hu is essentially an informational website. Personal data may arise in two ways: first, when a visitor voluntarily contacts us (using the form on the Contact page, by email, or by telephone); and second, automatically, through the operation of the web server and the Cloudflare Turnstile spam filter used on the Contact page (for example, the logging of IP addresses).
3. What personal data may we process?
a) Data provided when contacting us:
- Name
- Email address
- Telephone number (if provided)
- Any other personal data contained in the text of the message
Providing this data is voluntary, but without it we are unable to respond to the inquiry.
b) Technical data processed by Cloudflare:
- IP address
- TLS fingerprint
- User-Agent header (browser and device identifier)
- Origin data relating to the page
Note: under applicable European data protection law and the position of the NAIH (the Hungarian data protection authority), an IP address qualifies as personal data even where it does not directly identify an individual.
4. Purposes and legal bases of processing
a) Contact data:
Purpose: receiving, handling, and responding to incoming inquiries, and conducting the related communication.
Legal basis: for general inquiries, the data subject’s consent (Article 6(1)(a) GDPR); for quote requests, steps taken at the request of the data subject prior to entering into a contract (Article 6(1)(b) GDPR).
b) Technical data processed by Cloudflare Turnstile:
Purpose: the Cloudflare Turnstile widget placed on the Contact page processes the technical data listed above in order to filter out unsolicited, automated, or abusive submissions and to protect the secure operation of the website.
Legal basis: the legitimate interest of the controller (Article 6(1)(f) GDPR) in protecting the website and the contact channel.
Important: the Cloudflare Turnstile widget does not transmit the data entered in the contact form (name, email address, message) to Cloudflare’s servers.
c) Apache web server log (access log):
Purpose: in the course of operating the web server, Apache automatically logs incoming HTTP requests. The purpose of the log is to maintain the secure and reliable operation of the website, to diagnose errors, and to identify and investigate abuse and attempts at unauthorized access.
Data processed: IP address, requested URL, HTTP method, status code, User-Agent header, and time of the request.
Legal basis: the legitimate interest of the controller (Article 6(1)(f) GDPR) in operating the web service securely and investigating any abuse.
Retention period: server logs are kept for no more than 30 days, after which they are deleted automatically.
5. Processors and third parties
Only duly authorized staff of Serverguru Kft. have access to contact data. We do not sell the data and do not use it for general advertising purposes.
Serverguru Kft. itself operates the server environment that hosts the website and the email system, on virtual servers rented from an infrastructure provider operating within the European Union. As a processor, the infrastructure provider only ensures the physical operation of the servers and does not use the data for its own purposes.
Cloudflare, Inc. acts as a processor in connection with the Turnstile widget:
- Cloudflare, Inc., 101 Townsend St, San Francisco, CA 94107, USA
- Privacy policy: https://www.cloudflare.com/privacypolicy/
Transfers to a third country (USA): Cloudflare may also process the technical data it handles outside the European Union. Such transfers are based on the standard contractual clauses (SCCs) applied by Cloudflare (Article 46(2)(c) GDPR) and, where applicable, the EU–U.S. Data Privacy Framework (EU-U.S. DPF).
6. Cookies
The serverguru.hu website does not use cookies of its own. During spam filtering, the Cloudflare Turnstile widget on the Contact page may use technical data that is strictly necessary for its operation and, in some cases, cookies. These serve solely to protect the contact form and are not used for advertising or tracking purposes.
7. Automated decision-making and profiling
Serverguru Kft. does not carry out automated decision-making or profiling on the basis of the personal data it receives.
8. Retention period
Personal data provided when contacting us is kept for 1 (one) year from the closure of the inquiry and is deleted thereafter, unless a longer retention period is required by law or the controller needs to retain the data for longer in order to enforce a legal claim.
The retention period of technical data processed by Cloudflare is governed by Cloudflare’s own privacy policy.
9. Rights of the data subject
Data subjects may exercise the following rights against the controller:
- Right of access (Article 15 GDPR): to obtain confirmation as to whether we process personal data concerning them and, if so, to receive a copy of that data.
- Right to rectification (Article 16 GDPR): to have inaccurate personal data corrected or incomplete data completed.
- Right to erasure (Article 17 GDPR): to have their personal data erased, where certain conditions are met.
- Right to restriction of processing (Article 18 GDPR): to have the processing restricted, for example where they contest the accuracy of the data.
- Right to object (Article 21 GDPR): to object to the processing of their data where it is based on legitimate interests.
- Right to data portability (Article 20 GDPR): to receive, in a machine-readable format, their data processed by automated means on the basis of consent or a contract.
- Withdrawal of consent: where processing is based on consent, to withdraw that consent at any time, without affecting the lawfulness of processing carried out before its withdrawal.
Requests should be sent to info@serverguru.hu or by post to the address of the registered office. In accordance with Article 12 GDPR, the controller will, as a rule, act on a request within one month.
10. Remedies
